1.Refund Policy

We strive to provide the best experience for our users. If you are not satisfied with your purchase or experience on OrkaStores, please contact our customer support team at [email protected] within 30 days of purchase for a refund. Refunds will be issued in accordance with our Refund Policy, which may vary depending on the nature of the product or service. Payment is not refundable after 30 days of onboarding into our platform

2.Eligibility

You must be at least 18 years old and capable of forming a binding contract to use OrkaStores. If you’re using our platform on behalf of a business, you represent that you have the authority to bind that business to these Terms.

3.Account Registration

To use OrkaStores, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your login details and all activities that occur under your account.

4.Services

OrkaStores provides website-building tools, e-commerce features, and digital business solutions for small and medium businesses. We reserve the right to modify or discontinue Services at any time without notice.

5.Subscription & Payments
  1. Some features require a paid subscription.
  2. Subscription fees are billed in advance and are non-refundable.
  3. You are responsible for all applicable taxes and transaction charges.
6.User Responsibilities
  1. You must use our Services only for lawful purposes.
  2. You agree not to upload any content that is illegal, abusive, or violates third-party rights.
  3. You are solely responsible for the content and products listed on your OrkaStores site.
7.Shipping Policy

For physical products purchased through OrkaStores, the merchant will provide shipping information after the purchase. Shipping times may vary depending on your location and the shipping method provided by the merchant. We are not responsible for any shipping partners or delays or issues that may arise during the shipping process, but we will provide contact options in the merchant site to assist you in resolving any problems that may occur. OrkaStores is not responsible for any shipping partners being chosen by the merchants, as we are a platform that provides technology

8.Limitation of Liability and Indemnification

To the fullest extent permitted by law, OrkaStores and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from or related to your use of the Services. You agree to indemnify and hold harmless OrkaStores and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Services or violation of these Terms.

16.Legal Responsibility of Individual Business Merchants

Legally, individual business merchants are responsible for their products as per the respective laws of their country. While OrkaStores provides a platform for merchants to create their own online stores, each merchant is solely responsible for ensuring that their products comply with all applicable laws and regulations. OrkaStores does not assume any responsibility for the quality, safety, or legality of the products sold by individual merchants on our platform. Any disputes or issues related to products purchased from merchants should be addressed directly with the merchant in accordance with their own policies and applicable laws.

17.Access to Customer Accounts for Maintenance Purposes

To assist with setup and ongoing support, OrkaStores may request temporary access to your email and password specifically for the following services:

  1. Google Analytics
  2. Google Search Console
  3. Google Business Profile

This access is used only for setup, monitoring, and optimization of your store’s online presence. We regularly monitor the data from these platforms and share relevant insights with you to help identify and resolve issues that may impact your business performance.

This process is intended solely for quality assurance, analytics, and training purposes. We will never use your credentials for personal use or share them with unauthorized third parties. All data access and actions are carried out with your consent and for your benefit.

18.Change Requests

OrkaStores welcomes feedback and change requests from clients. However, implementing changes depends on several factors, including:

Relevance to other customers (adoption potential across the platform) Legal, security, or technological implications Development time and resource availability We will do our best to accommodate client-specific requests, but please note: Implementation timelines can vary significantly — from 3 months to several years, depending on the complexity of the request.

Some changes may require learning, testing, and integration into our platform.

If a third-party service or tool is required, it may involve a subscription fee. This cost may be covered either by the client or by OrkaStores, depending on the agreement.

If covered by OrkaStores on behalf of the client, the subscription cost will be reflected in the client’s invoice. We strive to make all enhancements scalable and secure, while balancing the needs of all users on our platform.

19.Customer Responsibilities

As a user of OrkaStores, the customer is responsible for managing and maintaining their own business operations and data within the platform. The following outlines the scope of customer responsibilities:

19.1 Product Management

Customers are solely responsible for:

Creating and maintaining accurate product titles, descriptions, images, prices, and delivery charges.

Ensuring the information is up-to-date and reflective of their actual offerings.

19.2 Platform Testing

We recommend that customers regularly test their online store to ensure it functions correctly.

If issues are found or assistance is needed, customers may contact us via:

19.3 Account Data

Customers are fully responsible for the data entered or stored in their account, including:

  1. Product details
  2. Customer orders
  3. Inventory and financial records
19.4 Website Legal Content

Customers are responsible for reviewing and maintaining their website's:

  1. Terms and Conditions
  2. Refund Policy
  3. Privacy Policy

OrkaStores does not provide legal advice and cannot be held accountable for missing or inaccurate policy content.

19.5 Order Management

Customers are responsible for:

  1. Reviewing and accepting customer orders
  2. Processing and delivering products
  3. Handling returns and customer complaints

OrkaStores only provides the software to manage orders; fulfillment is the client’s responsibility.

19.6 Payment Handling

OrkaStores integrates with third-party payment gateways such as:

  1. Razorpay
  2. Instamojo
  3. CCAvenue

Customers must:

Ensure that payment has been received into their respective merchant accounts.

Regularly monitor and reconcile payments.

19.7 Other Payment Modes

We also support:

  1. Cash on Delivery (COD)
  2. UPI-based payments

Customers are responsible for handling and verifying all transactions made through these modes.

19.8 Disputes and Legal Liability

In case of any legal disputes, fraud, or issues related to customers or government regulations, OrkaStores is not liable.

It is the responsibility of the store owner (customer) to comply with applicable laws, taxation rules, and consumer protection guidelines.

20. Customer Communication & Store Setup
20.1 WhatsApp Communication

To ensure smooth and quick communication, OrkaStores will create a dedicated WhatsApp group that includes the customer and the OrkaStores support team.

This is the primary communication method used by most of our customers.

We also support communication through phone calls for urgent matters.

Our support team strives to respond to 99% of queries in a timely manner.

20.2 Store Setup Timeline

Store setup can take anywhere from 5 minutes to 24 hours, depending on:

  1. The complexity of the request
  2. The availability of required content
  3. The priority level of the customer’s subscription plan
20.3 Platform Features and Subscriptions

OrkaStores offers a wide range of powerful features.

Feature access and usage are based on the customer’s subscription plan.

Customers are encouraged to explore and utilize all tools available under their current subscription.

20.4 Product Data Submission

Customers are responsible for providing accurate:

  1. Product Photos
  2. Titles
  3. Descriptions
  4. Prices

We may request edits to product descriptions to ensure they comply with:

  1. Google’s content policies
  2. Local laws and regulations

OrkaStores will advise customers on necessary changes, but it is the customer's responsibility to update product information.

Customers may choose to:

Submit product data to us for upload, or

Manage and update products themselves through the OrkaStores dashboard.

20.5 Pricing and Listings

Customers are responsible for:

  1. Setting and updating their product prices
  2. Ensuring accuracy of all product listings

Incorrect or misleading product listings may lead to customer dissatisfaction, complaints, or penalties under consumer law.
